Conditions de Transport

The expressions used in these Conditions of Carriage shall have the following meanings:

International Accords (IIA and MIA) of the International Air Transport Association (IATA) means the reference texts modifying certain provisions relating to our liability, signed on October 31, 1995, in Kuala Lumpur (IIA) and on April 3, 1996 in Montréal (MIA), which we have applied since April 1, 1997, and which fall within the legal framework of international texts relating to the liability of carriers (referred to hereafter by the terms the “Warsaw Convention” or the “Montréal Convention), as well as the Chicago Convention of December 7, 1944 and its Annexes, in particular Annexes 9, 17 and 18.

1. Air Carriage (or Air Travel)

Means the carriage of you and your luggage, from check-in to the departure gate, within the meaning of Article 17 of the Convention (see Convention, hereabove).

2. Airline Designator Code

3. Authorized Agent

4. Beneficiary

5. Carrier

Means us (AIGLE AZUR) or any carrier other than us of which the Designator Code appears on your ticket or on a Conjunction Ticket.

6. Checked Luggage

7. Check-in deadline

Means the time limit by which you must have completed check-in formalities.

8. Community air carrier

Means an air Carrier which holds a valid operating licence delivered by a Member State of the European Union, pursuant to the provisions of EU Regulation n° 2407/92 of July 23, 1992.

9. Conjunction Ticket

Means a Ticket issued to you with relation to another Ticket which together constitute a single Contract of Carriage.

10. Contract of Carriage

Means those statements contained in your Ticket or Ticket pouch, or in the Itinerary Receipt (Flight Details), identified as such and which incorporate, by reference, these Conditions of Carriage and notices (to passengers).

11. Convention

Means, depending on the case:
- the Convention for the unification of certain rules relating to international carriage by air, signed in Warsaw on October 12, 1929;
- the Hague Protocol of September 28, 1955, modifying the Warsaw Convention;
- the Guadalajara Supplementary Convention of September 18, 1961;
- the Montréal Protocols n° 1, 2 and 4 (1975), modifying the Warsaw Convention and
- the Montréal Convention of May 29, 1999, which entered into force on June 28, 2004.

12. Coupon

Means a paper Flight Coupon or an Electronic Coupon, each of which bears the name of the Passenger who is to take the flight identified on the Coupon.

13. Damage

Includes death, wounding, delays, loss, partial loss or other damage arising out of or in connection with carriage on flights we operate or other services we provide.

14. Days

Mean calendar days, including all seven days of the week, it being noted that for the purpose of notification, the day upon which notice is dispatched shall not be counted and that for the purpose of determining the validity of a Ticket, the day on which the Ticket was issued or the first flight commenced shall not be counted.

15. Electronic coupon

16. Electronic Ticket

Means the Flight Details (also called the Itinerary Receipt), issued by us or on our behalf, the Electronic Flight Coupon or any other document with the same value held in our database.

17. Fares

Means the fares, costs and Conditions of Carriage filed by a Carrier where requested with the appropriate authorities.

18. Flight coupon

Means the portion of the Ticket identified as being "valid for carriage" or, for Electronic Tickets, the Electronic Coupon that shows the exact points between which you must be carried.

19. Flight Details (or also Itinerary Receipt)

Means one or several documents which we issued to your attention, when you use Electronic Tickets, and which include the name of the Passenger, flight information and notices. It may also be called the “Itinerary Receipt”.

20. Force Majeure

Means external and unforeseeable events beyond your control, the consequences of which could not have been avoided even if all due care had been exercised.

21. Interior flight

Means any flight for which the departure and arrival town are within the same State, within territorial continuity.

22. International flight

Means, as defined by the Convention, any flight for which the departure point and arrival point and, possibly, the stopover point, are located on the territory of at least two States that are parties to the Convention, or in a single State if an intermediary stopover is scheduled in another State that is a party to the Convention.

23. Luggage

Means your personal property accompanying you during your trip. Unless otherwise specified, this term means both your checked and unchecked Luggage.

24. Luggage Check

Means those portions of the Ticket which relate to the carriage of your Checked Luggage.

25. Luggage Label

Means the portion of the Ticket which relates to the carriage of your checked luggage.

26. Passenger

Means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a Ticket (designated, in this text, by the word “you”).

27. Passenger Coupon or Passenger Receipt

Means the portion of the Ticket, issued by us or in our name, which is identified as such and must be retained by you.

28. Person entitled to compensation

Means you or any other person who may claim compensation in relation to a journey, pursuant to applicable law.

29. Rail flight/Sea flight/Road flight

Means combined carriage whereby air carriage and the other forms of carriage are sold together and may be performed under different liability systems.

30. Security Item

Means any object which, for reasons of security or safety, cannot be carried under current laws.

31. Special Drawing Rights

Are an international unit of account, defined by the International Monetary Fund (IMF), the value of which is regularly re-calculated by the IMF.

32. Special Interest Declaration

You may declare in writing a value which is greater than the limit of the liability indicated in the Convention, in consideration of the payment of a surcharge.

33. Stopover

Means a stop scheduled by you on your route at a place between the place of departure and the place of destination.

34. Stopping Places

Are those places, except for the place of departure and the place of destination, indicated on the Ticket or mentioned in our timetables as scheduled stopping places in your itinerary.

35. Ticket

Means either the document entitled "Passenger Ticket and Luggage Check" or the Electronic Ticket issued by us or on our behalf. It constitutes the Carriage Contract, which includes the Flight coupons and notices to passengers and also, by reference, these General Conditions of Carriage.

36. Unchecked Luggage
