Conditions de Transport

The expressions used in these Conditions of Carriage shall have the following meanings:

International Accords (IIA and MIA) of the International Air Transport Association (IATA) means the reference texts modifying certain provisions relating to our liability, signed on October 31, 1995, in Kuala Lumpur (IIA) and on April 3, 1996 in Montréal (MIA), which we have applied since April 1, 1997, and which fall within the legal framework of international texts relating to the liability of carriers (referred to hereafter by the terms the “Warsaw Convention” or the “Montréal Convention), as well as the Chicago Convention of December 7, 1944 and its Annexes, in particular Annexes 9, 17 and 18.

.ARTICLE III : TICKETS

1. 1. General provisions

(a) We only accept to carry Passengers who have a Ticket in their name and Passengers may be requested to provide evidence of their identity in this regard.
(b) Tickets may not be transferred.
(c) Certain Tickets, which are sold at reduced fares, are partially or totally non-refundable. It is up to you to choose the fares which best correspond to your needs and to ensure to take out the appropriate insurance to cover the circumstances under which you would have to cancel your journey.

(d) If you possess a Ticket as described in paragraph (c) above, which is not used and you are prevented from travelling for reasons of Force Majeure, as defined in Article I hereabove, we shall credit you the amount of your non-refundable Ticket, for a subsequent journey and subject to reasonable administrative fees, provided that you inform us as soon as possible prior to the date of the flight and provide us with proof of such instance of Force Majeure.

(e) The Ticket shall at all times remain the property of the issuing Carrier.

(f) With the exception of Electronic Tickets, you may only be carried if you are able to present a valid Ticket that contains the Coupon that corresponds to the flight concerned and all other unused Coupons, as well as the Passenger Coupon. Moreover, a Ticket that is damaged or has been modified by a person other than us or our Authorized Agent shall not be valid for carriage. For Electronic Tickets, you shall only be carried on a flight if you provide satisfactory proof of identity and if a valid Electronic Ticket has been issued in your name.

2. 2. Validity period

(a) Except as otherwise provided for in the Ticket or in these Conditions of Carriage or the Fares, as defined in Article I hereabove, (in the case of Fares that affect the validity period of a Ticket, as stated on the Ticket itself), a Ticket is valid for carriage:

- for one year, as from the date of issue thereof, or,

- for one year, as from the date of use of the first Coupon, if such use occurs within one year of the issue thereof.

(b) If you are unable to travel during the validity period of your Ticket because, when you request a reservation on a flight, we are not in a position to confirm such reservation, the validity of said Ticket shall be extended or the Ticket may give rise to a refund, under the conditions provided for in Article X below.

(c) If, after having started your journey, you are prevented, for health reasons, from continuing your journey during the validity period of the Ticket, we may extend the validity of the Ticket upon presentation of an appropriate medical certificate, until the date on which you are once again in a position to travel or until the date of the first available flight. This extension shall only start at the point at which the journey was interrupted and shall be valid for carriage in the class of the fare paid. If the unused Flight Coupons remaining in the Ticket, or in the case of an Electronic Ticket, in the Electronic Coupon, contain one or more agreed stopping places, the validity of this Ticket may be extended by three months at the most, as of the date shown on the medical certificate. In the same way, we shall extend the validity of the Tickets of the immediate family members who are accompanying you.

(d) In the event of the death of a Passenger during a journey, the Tickets of the persons who are accompanying the deceased Passenger may be changed, either by waiving any minimum stay requirements or by extending the validity of said Tickets. In the event of the death of an immediate family member of a Passenger whose journey has started, the validity of their Tickets and of those of the members of their immediate family travelling with them may be changed in the same way.

(e) Any change mentioned in paragraph (d) above may only be made after receipt of a valid death certificate and any extension provided by this article cannot exceed forty-five (45) days as from the date of death.

3. 3. Coupon order of use

(a) The Ticket which you have bought is only valid for the carriage indicated thereon, from the departure point to the arrival point, via any intermediary Stopover scheduled when the Ticket was purchased. The fare that you paid corresponds to the route stated on the Ticket and is an integral part of the Contract of Carriage concluded with you. Your Ticket will not be accepted and shall lose all validity if all of the Coupons are not used in the order in which they are issued.
(b) If you wish to change all or part of your journey, you should contact us first. The fare will be recalculated and you will have the possibility to accept the new price or to maintain the original journey, as stated on the Ticket. If you must modify your Ticket due to a Force Majeure event, as defined in Article I hereabove, you should contact us as soon as possible and we shall endeavour to carry you to your next intermediary Stopover or to your destination, without any change in the fare.
(c) If you change your journey without our accord, we will calculate the new fare which corresponds to such change. You must then pay the difference between the fare which corresponds to the journey you bought and the price of the new journey. If the new fare is less than the original fare, we shall reimburse the difference to you but, in all cases, your original Coupons shall no longer be valid.
(d) Although certain changes will not give rise to any changes in fare, others, such as the change of the point of departure (for example, if you do not use the first Coupon) or destination of your journey, may result in a change in fare. Many fares are only valid for the dates and the flights stated on the Ticket and cannot be modified, unless, in certain cases, a fare supplement or modification penalty is paid.

(e) Each Flight Coupon in your Ticket shall be valid for the class specified therein, on the date and for the flight which corresponds to the reservation which was made. If a Coupon is issued without specifying a reservation, a reservation may be made at a later date, pursuant to fares in force and subject to the availability of seats on the flight requested.

(f) If you do not show up for a flight, we may cancel your reservations for the onward or return flights unless you inform us in advance that you are not going to be on such flight.

4. 4. Name and address

Our name may be abbreviated on the Ticket to our Designator Code or to any other form. Our address is considered to be the address of the airport of departure indicated next to your name, which appears in the “Carrier” box on the Ticket, or in the case of an Electronic Ticket, as indicated for the first portion of our flight, in the Flight Details (or Itinerary Receipt).
